Preamble
MoOngy, S.A., a public limited company with registered office at Rua Sousa Martins, 10, 1050-217 Lisbon, Portugal, with the sole registration and tax identification number 507 431 073 and a share capital of 300,000 euros, is the owner of the MobyFinder product.
Hereinafter, the owner of the product is referred to as “MoOngy”, the application as the “Application” or the “MobyFinder Application”, and the natural or legal person using it as the “user”.
These Terms and Conditions govern access to and use of the Application and apply from its first use.
If the user does not agree with these Terms and Conditions, the user must not use the MobyFinder Application.
Invalidity of any provision
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Services Provided
MobyFinder is an electric mobility support application for Android Automotive that provides information on the location, features, pricing and availability of charging points, taking into account the vehicle’s maximum charging power, the intended charging profile and the tariffs of Charging Point Operators and Electricity Retailers for Electric Mobility (CEME), as well as Grid Access Tariffs.
3.1 Virtual queues and push notifications
The Application allows the user to join virtual queues at charging points. The position in the queue is indicative only and does not constitute a reservation of the charging point. When the user joins a virtual queue, the Application requests permission to send push notifications on the status of that queue: if the user accepts, the user will receive them; if the user declines, the user will not receive push notifications but may continue to use the other services. This permission may be withdrawn at any time in the system settings.
Account
4.1 System Requirements and Compatibility
To use the Application, the user needs a vehicle running Android Automotive, version 10 or higher, and an internet connection. System requirements may be changed for technical or security reasons.
Internet connection costs are borne by the user, under the terms of the user’s agreement with the respective service provider.
4.2 Account creation and deletion
To use MobyFinder, the user signs in with their Google account on the vehicle’s Android Automotive system.
The user must keep their credentials secure and notify MoOngy immediately of any unauthorised use of their account. The user may request the deletion of their account at any time via support@dxspark.com.
Changes, updates and support
MoOngy may change, update or improve the Application, namely for technical, security or legal reasons. Updates may be installed automatically and the Application may be temporarily unavailable during that period. Whenever a change materially and adversely affects the use of the Application, the user will be informed with reasonable prior notice and may stop using the Application and request the deletion of their account.
If the user submits suggestions or feedback about the Application, MoOngy may use them freely and without consideration to improve its services, without prejudice to the protection of personal data.

Integrated Third-Party Services
The Application may contain links to or information from third parties, such as charging point operators or electricity retailers (hereinafter “Third-Party Services”). MoOngy does not control Third-Party Services, which are governed by the terms of their respective providers, and is not responsible for their quality, availability or content.
User Obligations
The user undertakes to use the Application lawfully and in accordance with these Terms and Conditions, not to engage in any acts that jeopardise the security of the Application or of other users, and to notify MoOngy of any security incident of which the user becomes aware, namely the loss or theft of credentials or unauthorised access to their account.
Breach and intellectual property
In the event of a breach of these Terms and Conditions, MoOngy may, on a proportionate basis, suspend or terminate the user’s access to the Application, informing the user of the reasons, unless prevented by law, and without prejudice to any other legal remedies.
The Application and its contents are the property of MoOngy or its licensors. The user is granted a personal, non-exclusive and non-transferable licence to use the Application for their own purposes; copying, modifying or commercially exploiting the Application is not permitted. Third-party trademarks and content belong to their respective owners.
Liability
MoOngy seeks to ensure the proper functioning of the Application but does not guarantee that it will be available on an uninterrupted or error-free basis. To the extent permitted by law, MoOngy shall not be liable for damage resulting from service interruptions, from Third-Party Services or from use of the Application in breach of these Terms and Conditions. Nothing in these Terms and Conditions excludes or limits MoOngy’s liability where the law does not permit it, namely in cases of wilful misconduct or gross negligence or of damage to life, physical integrity or health, nor the rights granted to consumers by law.
The information displayed in the Application, including prices, tariffs and availability of charging points, is partly provided by third parties and is indicative only. MoOngy undertakes to use its best efforts to keep it accurate and up to date; the conditions applied at the charging point at the time of use shall prevail.
Privacy Notice
MoOngy respects the user’s privacy. The processing of personal data in connection with the Application is described in the MobyFinder Privacy Policy, available in the Application, which the user should read before using it.
Road safety
The driver must give priority to driving and comply with the Highway Code and all other applicable road safety rules, regardless of their location. The Application must not be operated in a way that distracts from driving, and some features are only available when the vehicle is stationary.
The user is solely responsible for complying with those rules and for the driving decisions they make, including those based on the information displayed by the Application.
Updates to the Terms
MoOngy may update these Terms and Conditions, namely to reflect new features or legal changes. Significant changes will be notified in the Application and to the e-mail address registered in the user’s Account and will take effect seven (7) days after the notification is sent. If the user does not agree with the changes, the user may stop using the Application and request the deletion of their account.
Changes required by law may take effect on the date required by the applicable law.
Termination of the Service
The user may stop using the Application and request the deletion of their account at any time. MoOngy may suspend or terminate a user’s access in the cases provided for in these Terms and Conditions or for security reasons or where required by law.
MoOngy may discontinue the Service, in whole or in part, by informing users with reasonable prior notice, except where this is not possible for security reasons or where required by law.
Governing law and dispute resolution
These Terms are governed by Portuguese law, without prejudice to any applicable mandatory consumer protection rules. Disputes shall be submitted to the courts having jurisdiction under the law.
In the event of a consumer dispute, the user may refer the matter to an alternative dispute resolution entity, such as the Lisbon Consumer Arbitration Centre (Centro de Arbitragem de Conflitos de Consumo de Lisboa, www.centroarbitragemlisboa.pt) or CNIACC (www.cniacc.pt); the full list is available on the Consumer Portal (www.consumidor.gov.pt). The user may also file a complaint in the Electronic Complaints Book (Livro de Reclamações Eletrónico, www.livroreclamacoes.pt).
